Acceptance and eligibility

These Terms of Service (“Terms”) govern your access to and use of joinopencourt.com, the OpenCourt web application, and related services (together, the “Service”). By using the Service, you agree to these Terms and our Privacy Policy.

You must be at least 13 years old to use OpenCourt. If you are under the age of legal majority where you live, you represent that a parent or legal guardian has permitted you to use the Service and participate in volleyball activities arranged through it.

Accounts and sign-in

You are responsible for providing accurate account information and keeping access to your email and any connected Google or Apple account secure. You may not impersonate another person, create an account for someone without permission, or transfer your account to another person.

Tell us promptly if you believe your account has been accessed without permission. We may require identity verification before restoring access or responding to certain requests.

What OpenCourt does

OpenCourt helps players and captains discover, post, request, fill, and coordinate volleyball openings. Unless we expressly say otherwise, OpenCourt is not the organizer, owner, operator, employer, agent, or insurer of a game, team, league, venue, captain, or player.

Players arrange games with one another. OpenCourt does not guarantee that an opening, participant, venue, skill description, schedule, or attendance statement is accurate, safe, or available.

Openings, requests, and attendance

  • Post only openings you are authorized to coordinate.
  • Describe the game, skill level, position, time, and venue honestly.
  • Request a spot only when you genuinely intend and are able to play.
  • Respond to requests and communicate changes within a reasonable time.
  • Cancel promptly when plans change and avoid repeated preventable no-shows.
  • Submit attendance confirmations and reports truthfully.

Community conduct

You may not use OpenCourt to:

  • Harass, threaten, stalk, discriminate against, or exploit another person.
  • Post unlawful, deceptive, defamatory, obscene, or abusive content.
  • Spam users, scrape data, or use the Service for unauthorized commercial solicitation.
  • Bypass access controls, interfere with the Service, or probe it for vulnerabilities.
  • Upload malicious code or misuse another person’s account or information.
  • Encourage violence, unsafe conduct, or violations of venue or league rules.

We may review reports and take action we reasonably believe is needed to protect users, the community, or the Service.

Your content

You retain ownership of content you submit, such as profile information, photos, openings, messages, and feedback. You grant OpenCourt a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, and transmit that content only as reasonably needed to operate, secure, and improve the Service.

You represent that you have the rights needed to submit your content and that our permitted use of it will not violate another person’s rights. Feedback and product suggestions may be used without restriction or compensation to you.

Physical activity and personal safety

Volleyball and meeting people for games involve risks, including falls, collisions, physical injury, illness, travel, weather, venue conditions, and interactions with people you may not know. You are responsible for deciding whether a game, venue, or participant is appropriate for you.

Use suitable equipment, follow applicable rules, respect your physical limits, and seek professional medical advice when appropriate. For an emergency, contact local emergency services—not OpenCourt.

Venues and third-party services

Venue names, maps, directions, provider sign-in, and other third-party information are offered for convenience. Those products and locations are governed by their own terms and policies. OpenCourt is not responsible for third-party services, venue operations, closures, rules, fees, or conditions.

OpenCourt property

The Service—including its software, design, brand marks, text, graphics, and features—is owned by OpenCourt or its licensors and is protected by intellectual-property laws. These Terms give you a limited, revocable, non-transferable right to use the Service for its intended personal and community purposes. They do not transfer ownership of OpenCourt property.

Service changes and availability

We may add, change, suspend, or discontinue features; impose reasonable usage limits; or perform maintenance at any time. We do not promise that the Service will always be available, uninterrupted, secure, or error-free. You are responsible for maintaining independent copies of information you need outside the Service.

Suspension and termination

You may stop using OpenCourt at any time. We may restrict, suspend, or terminate access when we reasonably believe you violated these Terms, created risk or legal exposure, harmed other users, or misused the Service. Provisions that by their nature should continue after termination—including ownership, disclaimers, liability limits, and dispute terms—will survive.

Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” OpenCourt disclaims all express or implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, safety, and reliability. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, OpenCourt and its owners, operators, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from the Service, games, users, venues, or third-party services.

To the fullest extent permitted by law, OpenCourt’s total liability for all claims relating to the Service will not exceed the greater of the amount you paid OpenCourt in the twelve months before the event giving rise to the claim or one hundred U.S. dollars. These limits do not apply where they are prohibited by law.

Your responsibility for claims

To the extent permitted by law, you agree to defend, indemnify, and hold harmless OpenCourt and its owners, operators, and affiliates from claims, losses, liabilities, and reasonable expenses arising from your content, your conduct, your participation in a game, or your violation of these Terms or another person’s rights.

Governing law and disputes

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Before filing a formal claim, you and OpenCourt agree to try in good faith for 30 days to resolve the issue informally after written notice.

Unless applicable law requires otherwise, legal proceedings must be brought in the state or federal courts serving St. Charles County, Missouri, and each party consents to their jurisdiction and venue.

General terms

If a provision of these Terms is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or transfer of the Service. These Terms and the Privacy Policy are the entire agreement between you and OpenCourt regarding the Service.

Changes and contact

We may update these Terms as OpenCourt changes. We will update the date above and provide additional notice when required. Continued use after updated Terms take effect means you accept the updated Terms.
